Protecting the privacy and personal health information of individuals and organizations is very important to us. This notice explains how information collected from client organizations and/or individuals may be used and when McCalister and Associates, LLC may disclose that information to others.

McCalister is required, by law, to protect the privacy of your health information. This notice explains how information collected from you may be used and when information may be “disclosed”. Your rights regarding your health information are described in this notice. The terms “information” or “health information” in this notice include any personal information that is created or received by McCalister service providers as it relates to your participation in health promotion services provided to you.
Protection of Personal Health Information
McCalister and Associates may collect and maintain oral, written and electronic information to administer and provide certain client purchased programs and services. Established physical, electronic and procedural security safeguards to properly handle McCalister program participant information and to protect against risks such as loss, destruction or misuse in compliance with all applicable regulations and laws are in practice by McCalister.
How Health Information is Used
McCalister and Associates, LLC will not distribute or disseminate your personal health information to your employer and will only release personal information to a third party, such as a health plan sponsor, with your express written permission and only for the purpose of: administering additional wellness programming; additional health plan services; conducting other health plan activities as permitted by law; compliance with applicable law or response to a valid legal process. McCalister reserves the right to share de-identified aggregate health information to an employer or plan sponsor when appropriate release of information is executed by you. McCalister must obtain your written authorization to use or disclose your health information. If a use or disclosure of health information is prohibited or materially limited by other applicable law, it is McCalister and Associates’ intention to meet the requirements of the more stringent law.
The Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule gives individuals the right to revoke, at any time, an Authorization they have given. The revocation must be in writing, and is not effective until the covered entity receives it. In addition, a written revocation is not effective with respect to actions a covered entity took in reliance on a valid Authorization, or where the Authorization was obtained as a condition of obtaining insurance coverage and other law provides the insurer with the right to contest a claim under the policy or the policy itself.
The HIPAA Privacy Rule requires that the Authorization must clearly state the individual’s right to revoke; and the process for revocation must either be set forth clearly on the Authorization itself, or if the covered entity creates the Authorization, and its Notice of Privacy Practices contains a clear description of the revocation process, the Authorization can refer to the Notice of Privacy Practices. Authorization forms created by or submitted through a third party should not imply that revocation is effective when the third party receives it, since the revocation is not effective until a covered entity which had previously been authorized to make the disclosure receives it.
Advertising and Marketing
McCalister does not accept any advertising on our website. Any mention of, or link to, a particular service, product, or organization is not an endorsement by us, but rather is mentioned as further information or to ensure client program participants will be aware of programs for which they are eligible.

McCalister takes stringent precautions to protect information sent to us on this site. Please be aware that un-encrypted information sent to McCalister via this site is not secure. Consequently, McCalister is not responsible for the security of information transmitted via the internet.
